Number of Maegashira rikishi are not restricted. The number Kyokai 
want to keep it as much as possible is the number of Makuuchi
rikishi, including Yaku-rikishi (Yokozuna, Ozeki, Sekiwake, Komusubi).
If they feel they sould promote a particular rikishi, they will promote
to Sanyaku from Maegashira.

So the answer to your question will be, Tomonohana will remain at
the bottom of 40 Makuuchi rikishi. If that is 15-maime, that would 
be his rank for Aki-basho. That is my personal interpretation.

Also, number 40 of Makuuchi rikishi are not a magical number or 
god-given number. If there are no makekoshi rikishi in the bottom
half of maegashira and when there is a big kachikoshi rikishi at the
top of Juryo, there will be an extra promotion to Makuuchi. That is
also my personal interpretation.
